An altercation between Ethiopian federal police officers has led to a shooting incident at the premises of the Central Statistics Agency.

Aaron Maasho, a Reuters journalist covering Ethiopia and the African Union said the officers were guarding tablets expected to be deployed for census.

A journalist with the Ethiopian Reporter said the federal police had confirmed that two officers were killed in the incident. “The shooter is now under arrest,” Dawit Endeshaw said in a tweet.

Ethiopia’s parliament in June this year postponed a national census for a second time, citing security concerns.

Analysts, however, stressed that the move potentially undermined logistics for 2020 polls – the first election under Prime Minister Abiy Ahmed.

Ethiopia is due to hold a national vote some time next year, and the census – already postponed once from 2017 – is a crucial step towards demarcating constituencies.

But parliamentarians in both houses voted overwhelmingly to delay the census again by a year, due to an upsurge in ethnic conflicts.

Local level elections for the capital Addis Ababa and another chartered city Dire Dawa were postponed last week.


Proclamation No. …/2019


WHEREAS, it has become important to establish an independent electoral Implementation body in order to enable citizens to exercise their right to self-government through representatives that they elect by way of free, fair and peaceful elections conducted at various levels;

WHEREAS, to strengthen the Ethiopian democracy it has become necessary to organize the national electoral board in a manner that is independent from the influence of any other body and which enables it to conduct fair, trust-worthy and peaceful election;

WHEREAS, it has become necessary to improve the credibility and implementing capacity of the national electoral board among competing political organizations and the voting public, by    making the selection and appointment of the members of the national electoral board participatory and transparent and ensuring the board’s independence in regards to its organizational structure, staff employment and deployment and budget;

NOW, THEREFORE, in accordance with Article 55(1) and  102 of the constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows:




  1. Short Title

This Proclamation may be cited as the “National Electoral Board of Ethiopia Establishment Proclamation No. ____/2019”

  1. Definitions

In this proclamation:

1/         “Constitution” means the Constitution of the Federal Democratic Republic of Ethiopia; “Constitutions” means the Constitution of the Federal Democratic Republic of Ethiopia and that of the regional states;

2/         “Board” means the national electoral board that is established under Article 3 of this proclamation which includes all the members of the management board, the office of the board, and coordination offices at different levels;

3/         “Management Board” means a board that is comprised of the five members referred to in article 4 sub article 1 of this proclamation;

4/         “Election” means general elections, local elections, by-elections and re-elections conducted in accordance with Constitutions and other relevant laws;

5/         “Political Organization or Political Party” means a grouping which, having formulated a political program, pursues its aims in a lawful manner;

6          /“Constituency” means an electoral district established by dividing the nation’s territories in accordance with the law and in a manner conducive for the execution of elections and for the people to elect their representatives;

7/         “Polling station” means a location where voter registration, voting and counting is carried out for elections conducted at every level;

8/         “office” means Office of the National Electoral Board of Ethiopia;

9/         “High-level appointment” means appointment to the rank of minister, state minister, ambassador, commissioner, deputy commissioner, main director or appointment of a similar rank;

10/      “Ethical misconduct” means committing actions that are contrary to the moral values that the majority of Ethiopians abide by as well as to principles grounded in legal and professional ethics;

11/       “Person” means natural or Juridical person.

12/       Any expression in this proclamation in the masculine includes the feminine.



  1. Establishment

1/         The National Electoral Board (hereinafter referred to as “the board”) is hereby established having its own legal personality as an autonomous organ independent from influence of any government or other body.

2/         The board shall be accountable to the House of Peoples’ Representatives.

3/         The Board shall have head office in Addis Ababa. As may be necessary, the board may open branch offices at any place.

  1. The Organization of the board
  • The board shall have a management board consisting of 5 members that serve full-time.
  • Members of the management board, based on the decision of the board chairman shall be responsible to lead work departments of the board,
  • The Management board may establish sub-committees that may be necessary for the execution of its duties.
  • The board shall have the staffs necessary for the execution of its duties,
  1. Appointment of members of the management board

The members of the management board shall be appointed by the House of People’s Representatives In accordance with article 102 of the constitution, upon nomination by the prime minister through the following procedure;

  • The prime minister shall establish an independent committee that will engage in the recruitment of nominees to membership of the management board. The committee shall Composed of the following members:
  1. Federal Supreme Court…..1 person
  2. Inter-religious council of Ethiopia….. 1 person
  3. Ethiopian academy of sciences….. 1 person
  4. Ethiopian confederation of employees….. 1 person
  5. Ethiopian chamber of commerce….. 1 person
  6. Ethiopian human rights commission…. 1 person
  7. Representatives from civil societies and elders, 3 persons
  • The members of the committee that shall be selected from the institutions under sub-article 1 of this article shall be persons whose neutrality and capability are ensured and when appropriate fulfill the criteria to become management board members under article 6 of this proclamation.
  • The committee shall receive nominations from the public, political organizations and civil societies as to persons fit to be members of the management board.
  • In accordance with the criteria listed under article 6 of this proclamation, the committee shall select nominees fit to be management board members from the suggestions made in a transparent and competitive process after securing the consent of the nominees. It shall make the list of nominees open to the public and send it to the prime minister.
  • The list of nominees prepared by the committee must be twice the number of available place in the board during the selection process.
  • The prime minister after receiving the list of nominees shall have consultation with representatives of competing political parties on the nominees presented.
  • The prime minister after having the consultation as per sub-article 6 of this provision shall select as necessary the chairman and deputy chairman of the management board and submit nominees equal in number to the available space in the board to the House of People’s Representatives for appointment.
  • A nominee to become a management board member will become a member only when approved by a two third majority Vote of the House of People’s Representatives.
  1. Criteria to be a management board member
  • A person shall become a management board member only if he fulfills the following criteria:
  1. Has Ethiopian citizenship
  2. Not a member of any political party;
  3. Has advanced professional qualification on matters related to election; especially law, political science, public administration, statistics, information technology and other related fields;
  4. of good ethics and character
  5. high leadership capacity that enable him to hold the responsibility assigned to him.
  • The composition of management board members shall take into account the ethnic and sex composition.
  1. Powers and Duties of the Board

The Board shall have the following powers and duties:

  • execute impartially any election and referendum conducted in accordance with the Constitution and with election law;
  • provide civic and voter education as well as grant permission to bodies providing similar education and follow-up and supervise.
  • register political parties, follow-up and supervise them in accordance with the law;
  • provide guidelines for the manner in which monetary funds may be contributed to political parties and in accordance with these guidelines allocate the funds;
  • determine the manner in which political parties may use media during elections;
  • undertake studies on how to divide electoral regions and present a recommendation to the House of Federation on the basis of those studies;
  • issue licenses to election observers and follow and supervise their activities;
  • establish branch offices of the Board at all regional and sub-regional levels;
  • determine the number of polling stations necessary to carry out an election;
  • establish nationwide the electoral regions and polling stations necessary to carry out an election;
  • ensure that competent and non-partisan electoral officers who enjoy public trust are recruited and trained;
  • collect and confirm data relating to elections and political parties;
  • coordinate political parties’ joint forum;
  • certify and officially announce election results;
  • provide administrative relief for complaints raised in the course of election
  • cancel election results and order re-election where it has been convinced that Violation pf law has occurred which would undermine the outcome of the election. In addition, hold individuals accountable for violations of law, fraudulent acts or disturbance of peace in relation to an election;
  • prepare and submit its budget to the House of Peoples’ Representatives; approve and implement the same;
  • prepare, approve and, as needed, amend the directive for elections taking place at all levels of government, and ensure the implementation of the same;
  • submit to the House of Peoples’ Representatives reports on its work;
  • carry out any other activities necessary to fulfill its responsibilities as defined in this Proclamation and other laws
  1. Powers and Duties of the Management Board

In addition to the powers and Duties given to the board through article 7 of this proclamation, the management board shall also have following powers and duties:

  • issue directives and regulations;
  • outline policy directions relating to the powers of the management board as listed above, and follow up their implementation;
  • serve as the final appeal body of the board for complaints; approve election results before officially announced;
  • cancel election results and conduct re election when Violation of law which would undermine the outcome of the election has occurred.
  • outline policies to govern liaisons between the management board, the office or staffs of the board and governmental or non-governmental institutions; implement the same;
  • appoint the Chief Executive and the Deputy Chief Executive of the secretariat as per article 20 sub article  1 of this Proclamation;
  • issue directive on ethics governing the Management Board Members; supervise the implementation of the same;
  1. Powers and Duties of the Chairman of the Management Board

The Chairman of the Management Board shall have the following powers and duties:

  • serve as the main superior and Chief Executive Officer of the Management Board;
  • represent the Board in its dealings with third parties;
  • call and preside over the meetings of the Management Board;
  • supervise the proper implementation of decisions of the Management Board;
  • Hire and administer staffs in accordance with the civil service law and a regulation that will be specially passed by government ;
  • determine the internal organization of the Board as well as the division of work among the management Board member in consultation with the management Board members;
  • prepare and submit to board the short and long-term work plan and budget of the office of the board and supervise its  implementation
  • ensure that employees for branch offices of the office were Hired from among the region’s qualified and impartial residents and in a manner that was transparent and inclusive
  • on the basis of the federal and state constitutions, prepare and submit to the board election timetables and supervise its implement  upon approval
  • ensure that the Board’s budget is used in line with the appropriate rules and regulations of finance;
  • Coordinate the joint political parties’ forum;
  • present any report on the activities of the Board and the office to the Management Board;
  1. Powers and Duties of the Deputy Chairman of the Management Board

The Deputy Chairman of the Management Board shall have the following powers and duties:

  • carry out the duties of the Chairman in the absence of the latter;
  • perform other duties specifically assigned to him by the Chairman.
  1. Rules of Procedure of the Management Board
  • There shall be a quorum where at least 3 members of the Management Board are present.
  • Decisions of the Management Board shall be made by a majority vote; however, in case of a tie, the Chairman shall have a casting vote.
  • The Management Board shall issue its own detailed rules of procedure.
  1. Membership Term of the Management Board
  • The term of office of management board members shall be two electoral terms
  • Management Board members may not be re-appointed for membership.
  • Notwithstanding sub-article 1 of this article, from among the three members of the first round Management Board to be appointed as per this Proclamation, other than the Chairman and the Deputy Chairman of the management board, two of them shall have membership term of 7 years.
  • The management board members to be appointed as per sub-article 3 of this article who will serve for term of office of 7 years shall be identified at the time of their appointment by the Prime Minister.
  • The House of Peoples’ Representatives shall appoint new management board members to replace the members whose terms have lapsed as per sub-article 3 of this article. Upon the nomination of the Prime Minister in line with article 5 of this Proclamation.
  • Notwithstanding to the provisions of sub-article 1 and 2 of this article, unless a management Board member leaves his membership on his own consent or is relieved by the House of Peoples’ Representatives because of:
    1. Inability to carry out his functions due to health reasons;
    2. Evident lack of capacity or competence to work;
    3. Serious ethical misconduct, or
    4. Absence from work for a consecutive period of six months

he shall not be relieved of his responsibilities.

  • For a period of 2 years after leaving their position on their own consent or are relieved by the House of Peoples’ Representatives, members of the management Board may not be appointed to any high government office.
  1. Leaving Office and Being Relieved of Office
  • Any person who is convinced that a management Board member should be relieved of office for the reasons stated in article 14 sub-articles (1), (2) and (3) may inform the Federal Judges Administration Assembly to that effect.
  • If the Federal Judges Administration Assembly, upon assessing the claim, is convinced that there are no sufficient reasons, it shall reject the claim. If, on the other hand, it is convinced that the claim has sufficient reasons and requires further investigation, it shall appoint an investigative committee to investigate the matter, and this committee should consist of:
    1. One Federal Supreme Court judge
    2. One technical expert whose area of expertise is directly relatedto the matter at hand
    3. One person representing the Ethiopian Human Rights Commission

3/         The judges administration council may temporarily suspend the powers and duties of a management board member whose case is still being investigated

4/         the board member shall have the right to defend himself and present evidence during the process of committee’s investigation.

5/         if the committee in its investigation find the complaint lodged to be accurate and that the management board member should be removed, the committee shall present its findings to the judges’ administration council who will in turn present it to the House of Peoples Representatives.

6/         the management board member regarding whom the complaint is lodged shall be removed from position if the decision is approved by2/3 majority of the House of Peoples Representatives.

  1. Ethics of management board members

While the specifics will be issued by the management board committee, any member of the management board shall:

1/         discharge his responsibility impartially, freely and in good faith

2/         not directly or indirectly support or oppose any political organization or private candidate participating in the election

3/         not seek any benefit out of confidential information that he obtained by virtue of being a management board member

4/         not disclose to a third party any confidential information of the board.

5/         refrain from any acts that in any way damages the credibility, impartiality and independence of the board or its members

  1. Rights of management Board Members

Any member of the management board shall have the following rights

1/         to participate and vote in any meetings of management board

2/         to refer and get access to documents of the board

3/         to be called by the board for meeting and know the agenda in a timely manner

4/         to request for an extraordinary meeting to be held

5/         to receive payment appropriate for his management board membership

6/         not to be arrested or prosecuted without permission of the House of Peoples Representatives except in the case of flagrante delicto.

  1. Conflict of interests of management board members

1/         a management board member shall immediately inform the management board and remove himself from duty when any situation of conflict of interest occurs which prevent him from carrying out his duties in a fair and impartial manner;

2/         where the situation provided in sub-article (1) above occurs, it shall be recorded in the minutes and decided upon by the rest of the management board members

3/         a decision or action shall be re-considered where management board member that has a conflict of interest with the matter participates in the decision or action in any capacity without notifying the management board about the situation

4/         any person claiming that a management board member has conflict of interest regarding a matter that he is involved in or with a matter being considered in a meeting he participated may immediately submit his evidence to the management board through the office

  1. appeal

1/         final administrative decisions of the management board may be appealed to the federal high court, and final decisions with regard to electoral process and results may be appealed to the federal supreme court

2/         Courts shall decide cases within one month since an appeal is lodged, however if the matter is of urgent nature, the court may be required to issue a decision that takes into account its urgency

  1. Salary and benefits of management board members

1/         The salary and benefits the chairman of the management board shall be the same as that of federal government minister.

2/         The salary and benefits of the rest of the management board members shall be the same as that of federal government state ministers.

3/         when management board members finish their term or quit after serving for more than half of their term, the management board chairman shall have the same right as a vacating federal government minister and the rest of the members of the management board shall have the same right as that of federal government state minister respectively based on “Rights and Benefits of Outgoing Heads of State and Government Officials, Members of Parliament and Judges proclamation”.

የኢትዮጵያ ፌዴራላዊ ዴሞክራሲያዊ ሪፐብሊክ ብሄራዊ ምርጫ ቦርድማቋቋሚያ አዋጅ

ዜጎች በየደረጃው በሚካሄድ ነፃ፣ ፍትሃዊና ሰላማዊ ምርጫ በመረጧቸው ተወካዮች አማካኝነት ራሳቸውን በራሳቸው የማስተዳደር ስልጣናቸውን በተግባር እንዲያውሉ ለማድረግ ነፃ የምርጫ አስፈፃሚ አካል አስፈላጊ በመሆኑ፣

በኢትዮጲያ ዴሞክራሲን ለማጠናከርብሄራዊ ምርጫ ቦርድን ከማናኛውም አካል ነፃ አድርጎ በማደራጀት ፍትሃዊ፣ ተአማኒና ሰላማዊ ምርጫ ለማስፈፀም የሚያስችለው መዋቅር እንዲኖረው ማድረግ አስፈላጊ በመሆኑ፣

የብሄራዊ ምርጫ ቦርድ አባላትን አመላመልና አሿሿም አሳታፊና ግልጽ በማድረግና የቦርዱን የመዋቅር፤ የሰራተኛ ቅጥርና ምደባ እንዲሁም የበጀት ነጻነት በማረጋገጥ በተፎካካሪ የፖለቲካ ድርጅቶችና በመራጩ ዘንድ ያለውን ተዐማኒነትና የማስፈፀም አቅሙን ማሳደግ አስፈላጊ ሆኖ በመገኘቱ፣

በኢ.ፌ.ድ. ሪ ሕገ-መንግሥት አንቀጽ 55(1) እና102 መሠረት የሚከተለው ታውጇል።

ምዕራፍ አንድ


  1. አጭር ርዕስ

ይህ አዋጅ “የብሄራዊ ምርጫ ቦርድ ማቋቋሚያ አዋጅ ቁጥር ___/2011” ተብሎ ሊጠቀስ ይችላል።

  1. ትርጉም

በዚህ አዋጅ ውስጥ፡-

  • ሕገ መንግስትማለት የኢትዮጵያ ፌዴራላዊ ዴሞክራሲያዊ ሪፐብሊክ ሕገ መንግስት  ሲሆን፤“ህገ መንግስታት” ማለት ደግሞ የኢትዮጵያ ፌዴራላዊ ዴሞክራሲያዊ ሪፐብሊክ እና  የክልል ህገ መንግስታት ማለት ነው።
  • ” ቦርድ” ማለት በዚህ አዋጅ አንቀፅ 3 መሰረት የተቋቋመው የስራ አመራር ቦርዱን ሙሉ አባላት ያቀፈጽህፈት ቤትና በየደረጃው ያሉ ማስተባበሪያ ጽህፈት ቤቶችን ያካተተ ብሄራዊ ምርጫ ቦርድ ነው፡፡
  • “የስራ አመራር ቦርድ” ማለት በዚህ አዋጅ አንቀፅ 4 ንዑስ አንቅ 1 ላይ የተመለከቱትን አምስት አባላት ያቀፈ ቦርድ ነው፡፡
  • ምርጫማለትበሕገመንግስታት እና በሌሎች አግባብነት ባላቸው ህጎች መሰረት የሚካሄድ የጠቅላላ፣ የአካባቢ፣ የማሟያ ወይም የድጋሚ ምርጫ ነው፡፡
  • ፖለቲካ ድርጅት ወይም የፖለቲካ ፓርቲ ማለት የፖለቲካ ፕሮግራም ነድፎ አላማውን በሕጋዊ መንገድ ለማራመድ የሚንቀሳቀስ ቡድን ነው፡፡
  • “የምርጫ ክልል” ማለት ለምርጫ አፈፃፀም እንዲያመች እና ህዝቡ ወኪሎቹን እንዲመርጥ በህግ መሰረት የሀገሪቱ ግዛት ተከፋፍሎ የሚደራጅ የምርጫ አካባቢ ነው፡፡
  • “የምርጫ ጣቢያ” ማለት በየደረጃው የሚካሄዱ ምርጫዎች ምዝገባ የሚካሄድበት፤መራጮች ድምፅ የሚሰጡበት እና ቆጠራ የሚካሄድበት ቦታ ነው፡፡
  • ጽህፈት ቤት ማለት የኢትዮጲያ ብሔራዊ ምርጫ ቦርድ ጽህፈት ቤት ነው፡፡
  • ከፍተኛ የመንግስት ሹመት ማለት በሚኒስትር፣ ሚኒስትር ዲኤታ፣ አምባሳደር፣ኮሚሸነር፤ ምክትል ኮሚሸነር፣ዋና ዳይሬክተር ወይም ተመሳሳይ ደረጃ ያለቸው ሹመቶችን ያካትታል።
  • “የስነ ምግባር ጉድለት” ማለት በየኢትዮጲያውስጥ ብዙሃኑ የሚስማማባቸውየግብረገብ እሴቶች እናበህጎችና በሙያ ስነምግባሮች ላይ የተመሰረቱ መርሆችንየሚጥሱ ተግባራት ፈጽሞ መገኘት ነው።
  • “ሰው” ማለት በህግ የሰውነት መበት የተሰጠው ወይም የተፈጥሮ ሰው ነው፡፡
  • በዚህ አዋጅ ውስጥ በወንድ ጾታ የተገለጸው የሴትንም ጾታ ያካትታል፡፡

ምዕራፍ ሁለት

ስለ ብሄራዊ ምርጫ ቦርድ

  1. መቋቋም
  • ብሄራዊ የምርጫ ቦርድ (ከዚህ በኋላ ‘’ቦርድ”) እየተባለ የሚጠራ የህግ ሰውነት ያለው ከማንኛውም የመንግስት ወይም ሌላ አካል ተጽእኖ ነጻ የሆነና ራሱን የቻለ አካል በዚህ አዋጅ ተቋቁሟል።
  • የቦርዱ ተጠሪነት ለህዝብ ተወካዮች ምክር ቤት ይሆናል፡፡

ቦርዱ በአዲስ አበባዋና ፅሀፈት ቤት የሚኖረው ሲሆን፣እንደ አስፈላጊነቱ በማናቸውም ቦታ ቅርንጫፍ ፅህፈት ቤት ሊከፍት ይችላል

  1. የቦርዱ አቋም
  • ቦርዱ ሙሉ ጊዜ የሚያገለግሉ አምስት አባላት ያሉት የስራ አመራር ቦርድ ይኖረዋል፡፡
  • የስራ አመራር ቦርድ አባላት በቦርዱ ሰብሳቢ ውሳኔ መሰረት የተለያዩ የቦርዱን አላማ ፈፃሚ የስራ ዘርፎችንበሃላፊነት ይመራሉ።
  • የስራ አመራር ቦርዱ ለስራው አፈጻጸም አስፈላጊ የሆኑ ንኡስ ኮሚቴዎችን ሊያቋቁምይችላል፡፡
  • ቦርዱ ለሥራው አስፈላጊ የሆኑ ሠራተኞችይኖሩታል።
  1. የስራ አመራር የቦርዱ አባላት አሰያየም

የስራ አመራር ቦርዱ አባለት በህገ መንግስቱ አንቀጽ 102 መሰረት በጠቅላይ ሚኒስትሩ አቅራቢነት በሚከተለው ስነ ስርዓት መሰረት በህዝብ ተወካዮች ምክር ቤት ይሾማሉ፤

1/ጠቅላይ ሚኒሰትሩ እጩ የስራ አመራር ቦርድ አባላት የሚመለምል የሚከተሉትን አባላት ያካተተ ገለልተኛ ኮሚቴ ያቋቁማል፡-

ሀ) ከፌዴራል ጠቅላይ ፍርድ ቤት ——-1 ሰው

ለ)   ከኢትዮጵያ ሐይማኖት ተቋማት ጉባኤ……1 ሰው

ሐ) ከኢትዮጵያ የሳይንስ አካዳሚ …………..1 ሰው

መ) ከኢትዮጵያ ሰራተኞች ኮንፌደሬሽን…….. 1 ሰው

ሰ)  ከኢትዮጵያ ንግድና ማህበራት ምክር ቤት ……… 1 ሰው

ረ) ከኢትዮጵያ ሰብዐዊ መብት ኮሚሽን ….1 ሰው

ሠ) ከሲቪል ማህበራትና ካገር ሽማግሌዎች የሚመረጡ 3 ሰዎች

2/    በዚህ አንቀፅ ንዑስ አንቀጽ 1 ስር ከተዘረዘሩት ተቋማት የሚወከሉት ወይም የሚመረጡትየኮሚቴ አባላት ገለልተኛነታቸውና ብቃታቸው የተረጋገጠ፣እንደ አግባብነቱ በአንቀጽ 6 ስር የተዘረዘሩትን የስራ አመራር ቦርድ አባልነት መስፈርቶች የሚያሟሉ ሊሆኑ ይገባል።

3/     ኮሚቴው ከህዝብ፣ ከፖለቲካ ድርጅቶችና ከሲቪል ማህበራትየስራ አመራር ቦርድ አባል ሊሆኑ የሚችሉ ግለሰቦችን ጥቆማ ይቀበላል።

4/    ኮሚቴው በዚህ አዋጅ አንቀጽ 6 ስር በተቀመጡት መስፈርቶች መሰረት  ግልጽና አወዳዳሪ በሆነ አካሄድ ከተጠቆሙት ሰዎች ውስጥ የስራ አመራር ቦርድ አባላት ሊሆኑ የሚችሉ እጩዎችን በመለየትና ፈቃደኝነታቸውን በማረጋገጥየእጩዎቹን ዝርዝር ለሕዝብ ይፋ በማድረግ፣ ለጠቅላይ ሚኒስተሩ ይልካል።

5/    ኮሚቴው የሚያዘጋጀው የእጩዎች ዝርዝር ምልመላው በሚካሄድበት ወቅት በስራ አመራር ቦርዱ ካሉት ክፍት ቦታዎች ቁጥር እጥፍ መሆን ይኖርበታል።

6/    ጠቅላይ ሚኒስተሩ እጩ የስራ አመራር ቦርድ አባላት ስም ዝርዝር ከኮሚቴው ከተቀበለ በኋላ ከተፎካካሪ የፖለቲካ ፓርቲዎች ተወካዮች ጋር በቀረቡት እጩዎች ላይ ምክክር ያደርጋል።

7/    ጠቅላይ ሚኒስትሩ በዚህ አንቀፅ ንዑስ አንቀጽ 5 ስር የተገለጸውን ምክክር ካደረገ በኋላ ከቀረቡት እጩዎች መካከል እንደ አስፈጊነቱ የስራ አመራር ቦርዱ ሰብሳቢና ምክትል ሰብሳቢ የሚሆኑትን እጩዎች እንዲሁም የስራ አመራር ቦርድ አባል ሊሆኑ የሚችሉትን በመለየት በስራ አመራር ቦርዱ ውስጥ ባሉት ክፍት ቦታዎች ቁጥር ልክ እጩዎችን ለሕዝብ ተወካዮች ምክር ቤት እንዲሾሙ ያቀርባል።

8/    አንድ እጩ በስራ አመራር ቦርድ አባልነት የሚሾመው የህዝብ ተወካዮች ምክርቤት በሁለት ሶስተኛ ድምጽ ሹመቱን ሲያጸድቀው ነው፡፡

  1. የስራ አመራር ቦርድ አባልነት መስፈርቶች

1/    አንድ ሰው የሰራ አመራር ቦርድ አባል ለመሆን የሚችለው የሚከተሉትን መስፈርቶች ሲያሟላ ነው፡-

ሀ)    ኢትዮጲያዊ ዜግነት ያለው፣

ለ)    የማንኛውም ፖለቲካ ድርጅት አባል ያልሆነ

ሐ)    ከምርጫ ጉዳዮች ጋር ተያያዥነት ባላቸው በተለይም በሕግ፣ በፖሊቲካል ሳይንስ፣ በሕዝብ አስተዳደር፣ በእስታቲስቲክስ፣ በኢንፎርሜሽን ተክኖሎጂእና ሌሎች ተዛማጅነት ባላቸው ዘርፎች ከፍተኛ ሞያዊ ብቃት ያለው፣

መ) መልካም ስነ ምግባር እና ሰብእና ያለው፣

ሠ) የተሰጠውን ሀላፊነት ለመሸከም የሚያስችል ከፍተኛ የአመራር ብቃት ያለው

2/    የቦርዱ አባላት ስብስብ የብሄርና የፆታዊ ተዋጽኦን ከግምት ውስጥ ያስገባ መሆን ይኖርበታል።

  1. የቦርዱ ስልጣንና ተግባር

ቦርዱ የሚከተሉት ስልጣንና ተግባራት ይኖሩታል፤-

  • በሕገመንግስቱ እና በምርጫ ሕግ መሰረት የሚካሄድ ማንኛውንም ምርጫ እና ህዝበ ውሳኔ በገለልተኝነት ማስፈጸም፣
  • የመራጮችና የስነዜጋ ትምህርት መስጠትና ተመሳሳይ ትምህርት ለሚሰጡ አካላት ፈቃድ መስጠት፣ መከታተልና መቆጣጠር፣
  • የፖለቲካ ድርጅቶችን መመዝገብ፣ በህጉ መሰረት መከታተልና መቆጣጠር፣
  • ለፖለቲካ ፓርቲዎች የገንዘብ ድጋፍ የሚደረግበትን መስፈርት ማውጣትና በመስፈርቱ መሰረት ድጎማውን ማከፋፈል፣
  • በምርጫ ወቅት የፖለቲካ ፓርቲዎችን መገናኛ ብዙሃንን አጠቃቀም መወሰን፣
  • የምርጫ ክልሎችን አከላለል በተመለከተ ጥናት አድርጎ ለፌዴሬሽን ምክር ቤት የውሳኔ ሃሳብ ማቅረብ፣
  • ለምርጫ ታዛቢዎች ፈቃድ መስጠት፣ የመከታተልና መቆጣጠር፣
  • የቦርዱን ቅርጫፍ ጽህፈት ቤቶች በሁሉም ክልልሎችና ከዚያ በታች ባሉ የአስተዳደር እርከኖች ማደራጀት፣
  • ምርጫን ለማስፈጸም የሚያስፈልጉ የምርጫ ጣቢያዎችን ቁጥር መወሰን፣
  • ምርጫንለማስፈጸምየሚያስፈልጉ የምርጫ ክልልና የምርጫ ጣቢያዎችንበመላሃገሪቱ ማደራጀት፣
  • ገለልተኛ፣ ብቃትና የህዝብ ተአማኒነት ያላቸው የምርጫ አስፈጻሚዎች መመልመልና ማሰልጠን፣
  • ከምርጫና ከፖለቲካ ድርጅቶች ጋር የተያያዙ መረጃዎችን ማሰባሰብ፣ ማጠናቀር፣ የምርጫ ህጎችንና አፈጻጸምን በመገምገም ማሻሻያ የሚያስፈልጋቸውን ጉዳዮች ለይቶ ለሚመለከተው አካል ማቅረብ፣
  • የፖለቲካ ድርጅቶች የጋራ መድረክን ማስተባበር፣
  • የምርጫው ውጤቶችን ማረጋገጥና ይፋ ማድረግ፣
  • በምርጫ ሂደት ለሚቀርቡ ቅሬታዎች አስተዳደራዊ መፍትሄ መስጠት፣
  • በምርጫ ሂደት የምርጫ ውጤትን የሚያዛንፍ የህግ ጥሰት ተከስቷል ብሎ ሲያምን ውጤቱን መሰረዝና ድጋሚ ምርጫ ማካሄድ፣ እንዲሁም በምርጫ ሂደት የተፈጸመ የህግ መጣስ፣ ማጭበርበር ወይም የሰላምና ጸጥታ ማደፍረስ ድርጊት የፈጸሙ ግለሰቦችን በህግ እንዲጠየቁ ማድረግ፣
  • በጀት አዘጋጅቶ ለህዝብ ተወካዮች ምክርቤት ማቅረብ፣ ማጸደቅና በስራ ላይ ማዋል፣
  • በየደረጃው የሚካሄዱ ምርጫዎችን መርሃግብር ሰሌዳእንዲዘጋጅ ማድረግ ማጽደቅ እንደአስፈላጊነቱ ማሻሻልና መፈጸሙን መከታተል፣
  • ለህዘብ ተወካዮች ምክርቤት የስራ አፈፃጸም ሪፖርት ማቅረብ፣
  • በዚህ ሕግና በሌሎች ሕጎች የተሰጡትን ሃላፊነቶች ለመወጣት አስፈላጊ የሆኑ ማንኛውንም ተግባራትን ማከናወን፡፡
  1. የስራ አመራር ቦርድ ስልጣንና ተግባር

የስራ አመራር ቦርድ በዚህ አዋጅ አንቀጽ 7 ለቦርዱ በአጠቃላይ ከተሰጠው ስልጣንና ተግባራት በተጨማሪ የሚከተሉት ስልጣንና ተግባራት ይኖሩታል፣

  • ደንቦችንና መመርያዎችን ያወጣል፣
  • ለቦርዱ የተሰጡ ዝርዝር ስልጣኖችን የሚመለከቱ የፖሊሲ አቅጣጫዎን ያስቀምጣል ተግባራዊነታቸውንም ይከታተላል፣
  • የቦርዱ የመጨረሻው ቅሬታ ሰሚ አካል ሆኖ ያገለግላል፣ የምርጫ ውጤቶችን ይፋ ከመደረጋቸው በፊት ያጸድቃል፣
  • የምርጫ ውጤትን የሚያዛንፍ የህግ ጥሰት በተከሰተ ጊዜ የምርጫ ወጤቶችን ይሰርዛል፣ ድጋሚ ምርጫ ያካሂዳል፣
  • የስራ አመራር ቦርዱ፣ የቦርዱ ጽ/ቤት፣ የቦርዱ ሰራተኞች የስራ ሂደት እንዲሁም ቦርዱ ከሌሎች መንግሰትታዊና መንግስታዊ ያልሆኑ ተቋማት ጋር የሚያደርጋቸው ግንኙነቶች የሚመሩበትን ፖሊሲያዘጋጃል፤ በስራ ላይ ያውላል፤
  • የቦርዱን ጽህፈት ቤት ሃላፊና ምክትል ሃላፊ በዚህ አዋጅ አንቀጽ 20 ንዑስ አንቀጽ 1 መሰረት ይሾማል፤
  • የስራ አመራር ቦርዱ አባላት የሚመሩበትን የስነ ምግባር መመሪያ ያወጣል፤ ተግባራዊነቱን ይከታተላል፡፡
  1. የስራ አመራር ቦርዱ ሰብሳቢ ስልጣንና ተግባር

የስራ አመራርቦርዱ ሰብሳቢ የሚከተሉት ስልጣንና ተግባራት ይኖሩታል፣

  • የስራ አመራር ቦርዱ የበላይ ሃላፊና ዋና ስራ አስፈጻሚ ሆኖ ያገለግላል፣
  • ቦርዱን ከሶስተኛ ወገኖች ጋር ባለው ግንኙነት ይወክላል፣
  • የስራ አመራር ቦርዱን ስብሰባ ይጠራል፣ ይመራል፣
  • የስራ አመራር ቦርዱ ውሳኔዎች ባግባቡ መፈጽማቸውን ይከታተላል፣
  • የፌደራል ሲቪል ሰርቪስ ሕጎችን መሠረታዊ መርሆችተከትሎ በመንግሥት በልዩ ሁኔታ በሚጸድቅ ደንብ መሠረት ሰራተኞን ይቀጥራል፣ያስተዳደራል፣
  • የቦርዱ የውስጥ አደረጃጀትና በስራ አመራር ቦርዱ አባላት መካከል ያለውን የስራ ክፍፍል ከስራ አመራር ቦርድ አባላት ጋር በመመካከር ይወስናል፣
  • የጽህፈት ቤቱን የአጭርና የረጅም ጊዜ እቅድና በጀት አዘጋጅቶ ለቦርዱ ያቀርባል፣ሲፀድቅም ተግባራዊ መደረጉን ይከታተላል፤
  • የቅርንጫፍ ጽህፈት ቤቶች ሰራተኞችን የሙያ ብቃት ካላቸውና ገለልተኛ ከሆኑ የክልሉ ነዋሪዎች መካከል ግልጽ፣ አሳታፊና አወዳዳሪ በሆነ መንገድ መቀጠራቸውን ያረጋግጣል፤
  • የፌደራልና የክልል ህገመንግስቶችን መሰረት በማድረግ የምርጫ አፈጻጸም የጊዜ ሰሌዳ አዘጋጅቶ ለቦርዱ ያቀርባል፣ሲጸድቅም ተግባራዊነቱን ይከታተላል፤
  • የቦርዱ በጀት አግባብነት ባላቸው የፋይናንስ ህጎችና መርሆች መሰረት ስራ ላይ መዋሉን ያረጋግጣል፣
  • የፖለቲካ ድርጅቶችን የጋራ መድረክያስተባብራል፣
  • ማንኛውንም የቦርዱንና የፅህፈት ቤቱን የስራ እንቅስቃሴ ሪፖርት ለስራ አመራር ቦርዱ ያቀርባል፣
  1. የስራ አመራር ቦርዱ ምክትል ሰብሳቢ ስልጣንና ተግባር

የስራ አመራር ቦርዱ ምክትል ሰብሳቢየሚከተሉት ስልጣንና ተግባራትይኖሩታል፤

  • ሰብሳቢ በማይኖርበት ጊዜ ተክቶ ይሰራል፣
  • በሰብሳቢው የሚሰጠውን ሌሎች ተግባራት ያከናውናል።
  1. የስራ አመራር ቦርዱ የስብሰባ ሥነ ሥርዓት
  • ከስራ አመራር ቦርዱ አባላት ሶስቱ ከተገኙ ምልዓተ ጉባኤይ ሆናል።
  • የስራ አመራር ቦርዱ ጉባኤ ውሳኔ በአባላት ድምፅ ብልጫ ይወሰናል ሆኖም ድምፅ እኩል የሚከፈል ከሆነ ሰብሳቢው የደገፈው ሐሳብ የስራ አመራር ቦርዱ ውሳኔ ይሆናል፡፡
  • የስራ አመራር ቦርዱ የራሱን ዝርዝር የአሰራርና የስብሰባ ስነ-ስርዓት መመርያ ያወጣል፡፡
  1. የስራ አመራር ቦርዱ አባላት የስራ ዘመን
  • የስራ አመራር ቦርድ አባላት የስራ ጊዜ ሁለት የምርጫ ዘመን ይሆናል።
  • የስራ አመራር ቦርድ አባላት ድጋሚበቦርድ አባልነት ሊሾሙ አይችሉም።
  • በዚህ አንቀፅ ንዑስ አንቀፅ 1 ላይ የተመለከተው ቢኖርም በዚህ አዋጅ መሰረት ከሚሰየመው የመጀመሪያው ዙር የስራ አመራር ቦርድ ሰብሳቢና ምክትል ሰብሳቢ ውጪ ካሉት ሶስት የስራ አመራር ቦርድ አባላት መካከል የሁለቱ አባላት የስራ ዘመን ሰባት አመት ይሆናል፡፡
  • በዚህ አንቀጽ ንዑስ አንቀጽ 3 መሰረትበተመለከተው አግባብ የሚሾሙ የስራ ዘመናቸው ሰባት አመት የሚሆኑ የስራ አመራር ቦርድ አባላት መጀመሪያ በጠቅላይ ሚኒስትሩለሹመት በሚቀርቡበት ጊዜ ይለያሉ፡፡
  • በዚህ አንቀፅ ንዑስ አንቀፅ 3 መሰረት የስራ ዘመናቸው በሚያበቃ አባላት ምትክ በዚህ አዋጅ አንቀጽ 5 በተደነገገው መሰረት ጠቅላይ ሚኒስትሩ ምትክ አባላት ለህዝብ ተወካዮች ምክር ቤት አቅርቦ ያሾማል፡፡
  • በዚህ አንቀፅ ንዑስ አንቀፅ 1 እና 2 የተደነገገው እንደተጠበቀ ሆኖ አባሉ በራሱ ፍቃድ ስራውን ከለቀቀ ወይም በህዘብ ተወካዮች ምክርቤት፡-

ሀ)   በህመም ምክንያት ተግባሩን በተገቢው ሁኔታ ማከናወን ባለመቻል ፣

ለ)    ግልጽ በሆነ የስራ ችሎታ ወይም ብቃት ማነስ፣

ሐ)    ከባድ የስነ ምግባር ጉድለት መኖር፣ወይም

መ)   መ)ለተከታታይ 6 ወራት በስራ ገበታላይ ባለመገኘት፡፡

ምክንያት ካልተሰናበተ በቀር ከኃሃላፊነቱ አይነሳም።

7/    የቦርድ አባል ከቦርድ ኃላፊነቱ በፈቃዱ ከለቀቀ ወይም ጊዜውን ጨርሶ ከተሰናበተ በኋላ ባሉት ሁለት አመታት ውስጥ በማንኛውም ከፍተኛ የመንግስት ሃላፊነት ሊሾም አይችልም።

  1. ስራ ስለ መልቀቅና ስለመሰናበት
  • አንድ የስራ አመራር ቦርድ አባል በዚህ አዋጅ አንቀጽ 14 ንዑስ አንቀጽ(1)፣ (2) እና (3)በተቀመጡት ምክንያቶች ከሃላፊነቱ ሊነሳ ይገባል ብሎ ያሰበ አካል ወይም ግለሰብ ጥቆማውን ለፌደራል ዳኞች አስተዳደር ጉባኤ ማቅረብ ይችላል።
  • የዳኞች አስተዳደር ጉባኤ የቀረበውን ጥቆማ መርምሮ በቂ ምክንያት የሌለው መሆኑን ካመነ ጥቆማውን ውድቅ ያደርጋል፡፡ ጥቆማው ምክንያታዊና መመርመር የሚገባው ነው ብሎ ካመነ፡-

ሀ)    ከጠቅላይ ፍርድ ቤት አንድ ዳኛ፣

ለ)    ከተያዘው ጉዳይ ጋር በቀጥታ የተገናኘ ሙያዊ ብቃት ያለው አንድባለሙያ እና

ሐ)    ከኢትዮጵያ ሰብዐዊ መብት ኮሚሽን የተወከለ አንድ ሰው

ያሉበት አጣሪ ኮሚቴ በመሰየም ጥቆማውን በተገቢ ሁኔታ እንዲጣራ ያደርጋል፡፡

3/    ጉዳዩ በመጣራት ላይ ሳለ የዳኞች አስተዳደር ጉባኤ ክስ የቀረበበት የቦርድ አባል በጊዜያዊነት በቦርዱ ስራ እንዳይሳተፍ ሊያግደው ይችላል፡፡

4/    ኮሚቴው በሚያጣራበት ሂደት ጥቆማ የቀረበበት የቦርድ አባል እራሱን የመከላከልና መከላከያ ማስረጃ የማቅረብ መብቱ ይጠበቅለታል፡፡

5/    ኮሚቴው በሚያደረገው ማጣራት ጥቆማው ትክክል መሆኑን ካረጋገጠና ይሄም ከሃላፊነት ሊያስነሳ የሚችል ነው ብሎ ካመነ ፣ የውሳኔ ሃሳቡን ለዳኞች አስተዳደር ጉባኤ ያቀርባል፤ ጉባኤውም የቀረበለትን የውሳኔ ሃሳብ ለሕዝብ ተወካዮች ምክር ቤት ያቀርባል፡፡

6/የቀረበው የውሳኔ ሃሳብ በሕዝብ ተወካዮች ምክር ቤት አባላት በሁለት ሶስተኛ ድምጽ ከጸደቀ ጥቆማው የቀረበበት የቦርድ አባል ከሃላፊነቱ ይነሳል።

  1. የስራ አመራር ቦርድ አባላት ስነ-ምግባር

ዝርዝሩ የስራ አመራር ቦርዱ በሚያወጣው የአባላት ሥነ ምግባር መመርያ የሚወሰን ሆኖ ማንኛውም የስራ አመራር ቦርዱ አባል፣

  • የተሰጠውን አላፊነት በገለልተኘነት፣ በነፃነትና በቅን ልቦና ማከናወን አለበት፤
  • ማንኛውንም በምርጫ የሚሳተፍ የፖለቲካ ድርጅትም ሆነ የግል ዕጩ በቀጥታም ሆነ በተዘዋዋሪ በመደገፍም ሆነ በመቃወም መንቀሳቀስ የለበትም፤
  • በስራ አመራር ቦርድ አባልነቱ ምክንያት ባገኘው ሚስጢራዊ መረጃ ጥቅም ማግኘት ወይም መሞከር የለበትም፤
  • የቦርዱን ሚስጥር ለ3ኛ ወገን አሳለፎ መስጠት ወይም ማባከን የለበትም፤
  • በማንኛውም ሁኔታ የቦርዱን ወይም የአባላቱን ተአማኒነት፣ገለልተኝነትና ነፃነት ከሚጎዳ ወይም ከሚያጎድፍ ማንኛውም ተግባር መቆጠብ አለበት፡፡
  1. የስራ አመራር ቦርዱ አባላት መብት

ማንኛውም የስራ አመራር ቦርድ አባል የሚከተሉት መብቶች ይኖሩታል፣

  • ማናኛውንም የስራ አመራር ቦርዱን ስብሰባ የመሳተፍና ድምፅየመስጠት፣
  • የቦርዱን ሰነዶች የመመልከት፣
  • የስራ አመራር ቦርዱን ስብስባ ጥሪ እና አጀንዳ በወቅቱ የማግኘት፣
  • አስቸኳይ ስብሰባ እንዲጠራ የመጠየቅ፣
  • በስራ አመራር ቦርድ አባልነቱ ሊያገኝ የሚገባውን ክፍያ የማግኘት
  • ከባድ ወንጀል ሲፈፅሙ እጅ ከፍንጅ ካልተያዙ በቀር በኃላፊነት ላይ እስካሉ ድረስ ያለ ህዝብ ተወካዮች ምክር ቤት ፈቃድ ያለመያዝና በወንጀል ያለመከሰስ መብት።
  1. የስራ አመራር ቦርዱ አባላት የጥቅም ግጭት
  • ማንኛውም የስራ አመራር ቦርድ አባል የተሰጠውን ሃላፊነት በፍትሃዊነትና በገለልተኛነት ለመወጣት እንዳይችል የሚያደርግ ማንኛውም አይነት የጥቅም ግጭት ያለበት ጉዳይ ሲገጥመው ወዲያውኑ ለስራ አመራር ቦርዱ በማሳወቅ እራሱን ማግለል ይኖርበታል።
  • በዚህ አንቀፅ ንዑስ አንቀፀ 1 የተጠቀሰው ሁኔታ ሲከሰት ጉዳዩ በቃለጉባኤ ተይዞ ጉዳዩ በቀሪዎቹ የስራ አመራር ቦርድ አባላት ይወሰናል።
  • ከጉዳዩ ጋር የጥቅም ግጭት ያለው የስራ አመራር ቦርድ አባል ሁኔታውን ሳይገልፅ በማናቸውም መንገድ ተሳትፎ ውሳኔ የተላለፈ ከሆነ ጉዳዩ እንደገና አንዲታይ ይደረጋል፡፡
  • ማንኛውም ሰው የስራ አመራር ቦርድ አባላት በሚያዩት ጉዳይ ጋር የጥቅም ግጭት አለ ብለው ካመኑ ማስረጃውን ወዲያውኑ በቦርዱ ጽህፈት ቤት በኩል ለስራ አመራርማቅረብ ይችላሉ፡፡
  1. ስለ ይግባኝ 

1/    የስራ አመራር ቦርዱ የሚሰጣቸው የመጨረሻ አስተዳደራዊ ውሳኔዎች በፌዴራል ከፍተኛ ፍርድ ቤት እንዲሁም የምርጫ ሂደትና ውጤትን በተመለከተ የሚሰጣቸው የመጨረሻ ውሳኔዎች በፌደራል ጠቅላይ ፍርድ ቤት በይግባኝ ሊታዩ ይችላሉ፡፡

2/    ፍርድ ቤቱ ይግባኙን በተቀበለ በአንድ ወር ጊዜ ውሰጥውሳኔ መስጠት ይኖርበታል፤ሆኖም ጉዳዩ አጣዳፊ ከሆነ ፍርድ ቤቱ የጉዳዩ ባህሪ በሚጠይቀው ፍጥነት ውሳኔ መስጠት ይኖርበታል፡፡

  1. የስራ አመራር ቦርድ አባላት ደሞዝና ጥቅማ ጥቅም
  • የቦርዱ ሰብሳቢ ደሞዝና ጥቅማ ጥቅም ከፌደራል መንግስት ሚኒስትር ጋር ተመሳሳይ ይሆናል።
  • የተቀሩት የቦርዱ አባላት ደሞዝና ጥቅማ ጥቅም ከፌደራል መንግስት ሚኒስትር ደኤታ ጋር ተመሳሳይ ይሆናል።
  • የስራ አመራር ቦርድ አባላት የስራ ዘመናቸውን ሲያጠናቅቁ ወይም ከግማሽ የአገልግሎት ዘመንበላይ ካገለገሉ በኋላ በፈቃዳቸው ስራ ከለቀቁ በከሀላፊነት የተነሱ የሀገርና የመንግስት መሪዎች፣ ከፍተኛ የመንግስት ሀላፊዎች፣ የምክር ቤት አባለትና ዳኞች መብቶችና ጥቅሞች አዋጅ መሰረት የቦርዱ ሰብሳቢ የተሰናባች ሚኒስተርን ሌሎች የስራ አመራር ቦርድ አባላት ደግሞ የተሰናባች ሚኒስተር ደኤታንመብቶችና ጥቅሞች ያገኛሉ፡፡

WHEREAS, is necessary to provide an electoral code of conduct for political parties, candidates, members and supporters of political parties to ensure that subsequent elections which draw lessons from previous elections are transparent, free, legitimate, fair, peaceful, democratic and acceptable by the people;

WHEREAS, Believing and accepting the impotence of full enforcement of human and democratic rights in our country for a legal civilized, democratic and peaceful competition for power;

WHEREAS, cognizant of the necessity to promote tolerance in a democratic process; and cognizant of the importance to conduct free political campaign and promote public dialogue during the electoral process;

WHEREAS, cognizant of the importance of working together on matters where the parties have common stand and to conduct a civilized and peaceful struggle on issues where they differ with firm readiness to accept the process and out come of legally conducted as an expression of the will of the people cognizant also of the need to create an environment where political parties can discharge their responsibilities in a spirit that is free of hatred and suspicion;

WHEREAS, cognizant of the need to enable political parties to play a vital role in strengthening multi-party democracy and democratic culture in good faith, tolerance and through the principle of give and take;

WHEREAS, it is necessary to emphatically declare that any attempt to stay in power against the will of the people or any local or external activity aimed at taking political power through any means other than those provided by the constitution are not acceptable.

WHEREAS, cognizant of the need to create an environment that would enable in mind the unique contribution which the value of the political parties to collectively stand for the implementation of this proclamation which contributes for the freedom of the press, human rights, democracy, rule of law and over all development of peoples;

WHEREAS, cognizant of the responsibility of exercise of the right to elect and be elected of any Ethiopian is not impeded by any influence or obstacle;

WHEREAS, cognizant of the responsibility of political parties to ensure that exercise of the right to elect and be elected of any Ethiopian is not impeded by any influence or obstacle.

WHEREAS, cognizant of the responsibility of political parties to conduct successive education and training; create awareness and support others who conduct education on this proclamation;

WHEREAS, realizing the importance to lay down procedures to investigate and subsequently rectify grievances submitted by political parties;

WHEREAS, cognizant of the need to lay down procedures for the implementation of this proclamation as well as for the establishment of Joint Council of political parties and determine their powers and responsibilities;

WHEREAS, it is necessary to issue a proclamation which reflects the principle which are internationally recognized and agreed upon by political parties;

NOW, THEREFORE, in accordance with Article 55(1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows:
